Diwali Gifts for Clients: What to Send and What the Law Allows
Six Diwali gifts for clients sorted by who receives them, with October 2026 cost estimates, the GST credit you lose on gifts, the ₹20,000 TDS total, and what the 2018 anti-bribery amendment means for a hamper sent to a PSU officer.

- • GST paid on goods given away as client gifts is generally not claimable: section 17(5)(h) of the CGST Act blocks input tax credit on gifts.
- • Section 393(1) of the Income-tax Act, 2025 (Table serial 8(iv), the old section 194R) requires 10% TDS once business benefits to one resident cross ₹20,000 in a tax year.
- • Since the 2018 amendment, a company can be fined if anyone associated with it gives a public servant an undue advantage to win business, and a consenting director faces 3–7 years.
- • In a cohort of 7,401 US neurologists, even a US$50 industry payment was linked to higher odds of prescribing the payer's drug (odds ratio 1.10).
- • SubhSandesh makes one page for one person and festival pages are 3.7% of 3,894 built, so it suits one client-friend, not a client list.

Diwali Gifts for Clients: What to Send and What the Law Allows
The safest Diwali gifts for clients are shared, useful or edible things priced under the client's own gift limit, delivered to their office with a named note, invoiced and logged. For anyone in government or a PSU who touches your file, send a card and nothing of value. The note does more work than the box, and SubhSandesh's own data shows how personal messages get read: 48.3% of shared pages are opened on a phone, and 38.5% of senders password-protect a page before sharing it (both measured 24 September 2026).
Diwali 2027 (Lakshmi Puja) falls on Friday 29 October, with Dhanteras on Wednesday 27 October, so aim for gifts to land in the week of 18 October. Below: six gifts by recipient, the GST and TDS lines, the 2018 bribery amendment and its evidence, a comparison table, and when to send nothing. None of this is legal or tax advice; check with your CA and the client's compliance team.
What counts as a Diwali gift to a client under Indian law?
A client Diwali gift is anything of value a business gives a person at a client organisation without payment, from a mithai box to cricket tickets. Indian anti-bribery law does not say "gift"; since the Prevention of Corruption (Amendment) Act, 2018, gazetted on 26 July 2018, it uses "undue advantage", defined as any gratification other than legal remuneration.
Two details in that definition decide a Diwali list. Gratification is "not limited to pecuniary gratifications", so a hamper, a hotel night or a dinner all count. Legal remuneration includes whatever the person's own government or organisation permits them to receive, which is why the client's gift policy, not yours, sets the ceiling.
6 Diwali gifts for clients, by who receives them
Each option gives what it is and who it suits, an estimated cost (October 2026, marked EST, not a quote), and the rule to check. None is a shop recommendation.
1. A sweets box for the client's whole team, sent to their office
One large box of mithai and namkeen addressed to the team rather than to the person who signs your purchase orders, for private-sector accounts where you work with five to fifteen people. Expect about ₹2,500–6,000 per office (EST). Rule to check: a box shared in the pantry reads as thanks, while the same value sent to one decision-maker's home reads differently.
2. A new bahi-khata for a trader client's Chopda Pujan
A red cloth-bound ledger of the kind many Gujarati and Marwari traders bless at Chopda Pujan on Lakshmi Puja evening, for proprietors and family firms who keep the ritual. Expect about ₹300–900 with a printed shubh-labh label (EST). Rule to check: ask once, quietly, whether they observe it, because for a client who does not it is clutter.
3. An engraved desk object marking the year you started working together
A brass paperweight or pen stand engraved with "since 2019" or the first project's name instead of your logo, for one senior contact on a long account. Expect about ₹1,200–3,000 including engraving (EST). Rule to check: engraved goods cannot go back to stock, so confirm the contact's policy limit first.
4. A craft piece from your own factory's district, for an overseas buyer
A small handmade piece from the town where your goods are made, with one line on who made it, for export clients who have never seen where their order comes from. Expect about ₹1,500–4,000 plus international courier (EST). Rule to check: sweets and liquids are where customs delays start, so a craft object travels better.
5. A signed card and nothing else, for a government or PSU contact
A card with a handwritten line and no voucher, sweets or anything else inside, for every officer at a ministry, government company or PSU bank who handles your file, tender or licence. Expect about ₹50–150 per card (EST). Rule to check: sections 8 to 10 of the Prevention of Corruption Act, explained below.
6. A personal greeting for the one client who has become a friend
A message written for one person, from you rather than the letterhead, for a contact you would still call if the contract ended tomorrow. Expect about ₹0–500 depending on format (EST). Rule to check: if a deal with them is open, the greeting carries nothing of value.
The tax lines on client gifts: GST credit and the ₹20,000 TDS total
The GST you pay on a client gift is usually a cost, not a credit. Section 17(5)(h) of the CGST Act, 2017, in CBIC's consolidated text as on 30 September 2020 blocks input tax credit on goods "disposed of by way of gift or free samples", so if a hamper invoice carries ₹300 of GST, budget that ₹300 as spend.
Income tax adds a line that employee-gift rules do not touch. Section 393(1) of the Income-tax Act, 2025, in force from 1 April 2026, carries the old section 194R as Table serial 8(iv): a giver of any business benefit or perquisite to a resident deducts tax at 10% once its value crosses ₹20,000. Individual and HUF givers fall outside it up to ₹1 crore of business turnover (₹50 lakh for a profession), and Note 2 to the Table applies it to gifts in kind too.
Section 194R of the 1961 Act ran the same 10% and ₹20,000 test from 1 July 2022 to 31 March 2026, so older books still use it. Either way, keep a running total per client for the year, adding the hamper to the match tickets and dinners.
When does a client gift become a bribe? The 2018 law and the evidence
Since 2018, giving is an offence in its own right. Section 8 punishes anyone who gives or promises an undue advantage to induce or reward a public servant's improper performance of a public duty, with up to seven years in prison, a fine or both; a person compelled to pay is exempt only if they report it within seven days.
Section 9 makes the company itself liable to a fine when anyone associated with it gives an undue advantage to a public servant to obtain or retain business, with one defence: proof of "adequate procedures" under guidelines the Act says will be prescribed. Section 10 adds three to seven years in prison for a director, manager or officer who consented or connived, so a written gift register and a no-gifts rule for public servants are worth having before October.
Small gifts still move decisions. A 2025 BMJ Open cohort of 7,401 US neurologists found 78.5% received industry payments between 2015 and 2019, at a median of US$779 each. Those paid were more likely to prescribe the payer's drugs, and even a US$50 payment carried higher odds (odds ratio 1.10), rising with size, duration and recency.
A 2026 systematic review of ten US studies found 38 of 44 comparisons (86%) pointed to more prescribing among clinicians who had received payments or industry contact. Both are observational, showing association rather than cause, but a client's procurement team works from the same logic, so a returned hamper is a policy doing its job.
Five client gift formats compared on cost, GST and lead time
The table groups the six options into five formats by cost, GST credit and how far ahead each must be organised. Lead times are our estimates except the last row.
| Format | Est. cost per recipient (Oct 2026, EST) | GST input credit | Lead time |
|---|---|---|---|
| Team sweets box to the office | ₹2,500–6,000 per office | Blocked under s.17(5)(h) | 3–5 days (EST) |
| Engraved desk object or bahi-khata | ₹300–3,000 | Blocked under s.17(5)(h) | 1–3 weeks (EST) |
| Craft piece to an overseas buyer | ₹1,500–4,000 plus courier | Blocked under s.17(5)(h) | 3–4 weeks with courier (EST) |
| Signed card to a government or PSU contact | ₹50–150 | Negligible | About 1 week by post (EST) |
| Personal Diwali page for one contact | Not priced in this post | No goods supplied | Same day: 86.1% of Raksha Bandhan 2026 pages finished in time were built within 24 hours (n = 89, nearest festival analogue) |
Every physical option loses its GST credit and needs days to weeks, so the order date is the real deadline. Only the card and the page can still go out on Dhanteras.
Where SubhSandesh fits for client gifts, and where it does not
SubhSandesh is not a corporate gifting service, and its own numbers say so. Festival and wedding pages are 144 of 3,894 pages built on it, 3.7% (measured 9 September 2026), and the other 96.3% are romantic and everyday pages, each made for one recipient.
It fits item 6, the client who has become a friend. SubhSandesh's Diwali page opens from a private link in any phone or laptop browser with no app or account, and lets them light a diya at their door with your tag, a row of wish diyas carrying your lines, a rangoli that glows with initials, and a letter from a red-and-gold shagun liffafa. Pick friend mode, add a password, and make them an interactive Diwali card with diyas, rangoli and a shagun liffafa in about five minutes.
Pages also get reopened, at 11.1 views per created page on average (measured 24 September 2026). For that contact's birthday or work milestone later, all SubhSandesh templates, across every occasion cover it, each still one page for one person.
When a Diwali gift for a client is the wrong move
If a tender, renewal or audit with that client is open around 29 October 2027, anything of value looks like an inducement whatever you meant, and a card is the ceiling. The same holds for a contact whose employer bans gifts, because sending one anyway leaves them the job of returning it.
A personal page loses too. A link from a vendor to a client you know only by designation reads as marketing, and for an office of forty one sweets box on the pantry table reaches everyone.
