Is Halloween a Public Holiday? What 7 Countries' Laws Say
No. Across the US, the UK, Ireland, Canada, Australia, India and the Philippines, 31 October appears on no official holiday list, so Halloween is not a public holiday in any of them. We read each government's 2026 list, plus the 2027 one wherever it was already out. The weekend saves most people the bother anyway: Halloween 2026 is a Saturday, Halloween 2027 a Sunday.
Because the day is an ordinary one, greetings get made and opened in the gaps. On SubhSandesh, 48.3% of shared pages are opened on a phone, and in Raksha Bandhan 2026, the nearest festival we have measured (89 pages, a different festival), 49.4% of pages were built on the day itself. Below: the legal test, each country's list, a comparison table, where 31 October really is a day off, and what that means for work and school.
What makes a day a public holiday?
A public holiday is a date that a law, proclamation or official list names as a non-working day, usually with paid time off for the workers it covers. Anything else is an observance: a day people mark, however keenly, without legal standing.
The two can sit far apart. A 2022 peer-reviewed study of Halloween in Slovakia by Katarína Popelková and Juraj Zajonc notes that Slovakia has 15 holidays recognised by law as non-working days. Its representative 2011 survey found 82% of Slovaks already knew Halloween, which arrived around 1990.
The authors still call it a "new" holiday, spread through school parties, discos and commerce rather than the statute book. That gap between familiar and official is the honest answer to "is Halloween a holiday?" almost everywhere: yes in the calendar people live by, no in the one employers must follow.
Halloween's legal status in 7 countries, 2026 and 2027
Each entry gives four things in the same order: the instrument, the nearest official holidays either side of 31 October in 2026, the 2027 position, and the catch. Dates were checked on 13 October 2026.
1. United States
The federal list in 5 U.S.C. 6103 names 11 holidays, and the Office of Personnel Management's federal holiday schedule prints them by year. Columbus Day falls on Monday 12 October 2026 and Veterans Day on Wednesday 11 November, with nothing between; in 2027 they are Monday 11 October and Thursday 11 November. The catch: the list binds federal employees only, and we did not survey state or school district calendars.
2. United Kingdom
GOV.UK's bank holiday calendar covers England and Wales, Scotland and Northern Ireland separately. After the summer bank holiday (3 August 2026 in Scotland, 31 August elsewhere), the only autumn date is Scotland's St Andrew's Day, Monday 30 November 2026, and Tuesday 30 November 2027. The catch: Bonfire Night on 5 November is not a bank holiday either.
3. Ireland
Ireland's 1997 working-time statute, Schedule 2, fixes a public holiday on "the last Monday in October". On the calendar that means 26 October in 2026 and 25 October in 2027, five and six days before Halloween. The catch: the holiday is pinned to a Monday, not the 31st, and Northern Ireland follows the UK list.
4. Canada
Section 166 of the Canada Labour Code defines 10 general holidays for federally regulated workers, and Halloween is not one. The CRA's public holiday page for 2026 goes from Thanksgiving, Monday 12 October, to Remembrance Day, Wednesday 11 November; the same rules give Monday 11 October and Thursday 11 November in 2027. The catch: provinces set holidays for most employees, and we did not check all 13 provincial and territorial calendars.
5. Australia
The Fair Work Ombudsman publishes every state's and territory's dates, and none lists 31 October. Its 2026 page has Recreation Day in parts of Tasmania on Monday 2 November and Melbourne Cup in Victoria on Tuesday 3 November; for 2027 it gives Monday 1 and Tuesday 2 November. The catch: some regional Victorian areas swap the Cup holiday for another date.
6. India
The Department of Personnel and Training's office memorandum of 3 July 2025 gives central government offices 14 compulsory holidays plus 3 picked from 12 optional ones. Its Delhi list of 34 restricted holidays jumps from Karwa Chauth on 29 October 2026 to Naraka Chaturdasi on 8 November, which is also Diwali. The catch: Halloween is not even a restricted holiday, and the 2027 memorandum was not on the DoPT site when we looked.
7. The Philippines
Here the days after Halloween are national non-working days. For 2026, Proclamation No. 1006 declares Sunday 1 November (All Saints' Day) and Monday 2 November non-working; Proclamation No. 1427, signed 8 September 2026, does the same for Monday 1 and Tuesday 2 November 2027. The catch: Lawphil's copy files 2 November 2027 under "special (working) day", while the preamble declares it an additional special (non-working) day, and we follow the preamble.
Halloween's legal status at a glance
The table groups the seven countries by who sets the holidays. The last column gives the nearest official day off after 31 October in each year.
| Countries | Who sets the holidays | 31 October | Nearest day off after it, 2026 / 2027 |
|---|---|---|---|
| United States, Canada | Federal law, plus states or provinces | Working day | 11 Nov (Wed) / 11 Nov (Thu) |
| United Kingdom, Ireland | Gov.uk list; Irish 1997 Act | Working day | 30 Nov, Scotland only (Mon) / 30 Nov (Tue) |
| Australia | Each state and territory | Working day | 2 Nov Tasmania, 3 Nov Victoria / 1 Nov, 2 Nov |
| India | DoPT memorandum each July | Working day | 8 Nov, Diwali (Sun) / 2027 list not found |
| Philippines | Presidential proclamation each September | Working day | 1–2 Nov (Sun–Mon) / 1–2 Nov (Mon–Tue) |
No country here gives 31 October off. Australia and the Philippines, though, put a real holiday within three days of it.
Where 31 October is a day off, for other reasons
A few countries do close on 31 October, and none is marking Halloween. Chile's Law 20.299 of 2008 makes it a holiday for the National Day of Evangelical and Protestant Churches, and Slovenia's 1991 holidays act lists 31 October, Reformation Day (dan reformacije), as a work-free day. In 2026 and 2027 both land on a weekend anyway.
Treat holiday apps with care. The Nager.Date public holiday dataset, which many calendar tools draw on, lists 31 October 2026 and 2027 as a Philippine public holiday called "All Saints' Day Eve". Neither Proclamation 1006 nor 1427 contains that date, so for anything that decides whether you work, read the instrument, not the app.
What a non-holiday Halloween means for work, school and banks
Because 31 October is not a holiday, nothing closes for it and nothing is carried over when it lands on a weekend. India's 2026 memorandum says in paragraph 3.2 that no substitute is given when a declared festival falls on a weekly off, and Halloween is not declared at all.
In 2026 and 2027 this matters less than usual, because Saturday 31 October 2026 and Sunday 31 October 2027 sit outside a Monday-to-Friday week. The weekday years return in 2028, when 31 October is a Tuesday. Then the route to a day off is annual leave, a shift swap or an early finish your employer agrees to, not a legal entitlement.
Sending a Halloween greeting when it's a working day
When the day is ordinary, the greeting has to fit around it. Across 57,456 recorded views, 48.3% of SubhSandesh pages were opened on a phone, and pages average 11.1 views each. During Raksha Bandhan 2026, 49.4% of pages were built on the day itself and 27.0% the day before, though that is a different festival and only 89 pages.
For one person to open in a lunch break, the interactive Halloween card with your photos and a pumpkin to carve takes about 5 minutes. Six photos at most, a flashlight-lit letter in the attic and a closing "Will you be my boo?"; it can be pitched at a partner, a friend, family or a child.
For a Sunday Halloween in 2027, the premium Halloween website with a voice note and an unlock time takes about 10 minutes. Its extras are a 60-second voice note, room for 12 photos and an optional unlock time, so the link shows only a countdown until the evening.
When a Halloween page is the wrong choice
Skip it if the person marks 1 and 2 November as days for the dead, as many Filipino families do; browse the other SubhSandesh templates for something quieter that week. Skip it for an office or a party too, since both Halloween pages are one-person greetings, not invitations for a crowd. And for a friend in Chile or Slovenia, 31 October is a religious day off, which a pumpkin joke may not suit.
